Terms of Service
Effective June 5, 2026
These Terms of Service ("Terms") govern access to and use of the AmplifyED Coaching Portal (the "Service") provided by AmplifyED ("AmplifyED", "we", "us"). By creating an account or using the Service, you ("Customer") agree to these Terms on behalf of your school, district, or organization.
Definitions
- • Customer: the school, district, or other organization that subscribes to the Service.
- • Authorized Users: Customer staff (admins, facilitators, teachers) granted access by the Customer.
- • End Users: students and parents whose information is processed in the Service.
1. Subscription & billing
- • Plans, features, and pricing are listed on the pricing page and may be updated from time to time.
- • Subscriptions are billed in advance on a monthly or annual cycle and auto-renew until canceled.
- • Fees are stated exclusive of taxes; Customer is responsible for any applicable taxes other than AmplifyED's income taxes.
- • Free trials, if offered, automatically convert to a paid plan on the date stated, unless canceled before the trial ends.
- • Past-due accounts may have access restricted after the grace period communicated in our billing notices.
2. Customer data ownership
Customer retains all right, title, and interest in Customer Data, including all student records and educational data submitted to the Service. AmplifyED processes Customer Data only as instructed by Customer and only as needed to provide the Service.

3. FERPA responsibilities
AmplifyED is designed to support Customer's obligations under the Family Educational Rights and Privacy Act (FERPA) and acts as a "school official" with a legitimate educational interest under 34 CFR § 99.31(a)(1)(i)(B), or as a service provider, under Customer direction.

4. Service availability
AmplifyED works to keep the Service available 24/7 and uses commercially reasonable efforts to do so. Standard plans do not include a specific uptime commitment; enterprise plans may include a written SLA. AmplifyED may perform scheduled maintenance and will use commercially reasonable efforts to do so outside of standard school hours.
5. Cancellation & data export
- • Customer may cancel a subscription at any time from the billing portal.
- • Cancellation takes effect at the end of the then-current billing period; Customer keeps access until that date.
- • Except where required by law, fees already paid are non-refundable and partial-period refunds are not issued.
Prior to account termination or expiration, Customer may export available records and data using AmplifyED's export tools, subject to the capabilities of the Service.
Following termination, Customer Data will be retained and deleted according to the organization's configured retention settings and AmplifyED's Data Retention Policy.
6. Customer responsibilities
Customer is responsible for:
- • Determining what information is entered into the Service.
- • Configuring user access permissions for Authorized Users.
- • Compliance with FERPA, COPPA, state education laws, and records-retention requirements applicable to Customer.
- • Determining whether information may be shared with teachers, staff, parents, or third parties.
- • Providing notices, obtaining consents, and operating its own privacy program as required by law.
AmplifyED provides technical controls but does not provide legal advice and does not assume responsibility for Customer's compliance obligations.
7. AI output disclaimer
The Service may offer AI-assisted features that generate draft content. Customer is responsible for reviewing AI-generated content before distribution or use. AmplifyED does not guarantee the accuracy, completeness, or appropriateness of AI-generated outputs.
8. Security disclaimer
No system can guarantee absolute security. While AmplifyED employs commercially reasonable safeguards designed to protect Customer Data, AmplifyED cannot guarantee that unauthorized access, cyberattacks, or other security incidents will never occur.
